OpenRV Subscription Policy Terms and Conditions

By accepting these standard terms, you authorize OpenRV (VIA PayPal) to automatically bill the charge card you have provided until a time after 12 months from the subscription start date. You can cancel your subscription at any time after the initial 12 month period has elapsed. There is one exception; OpenRV will offer a full refund and a stay from the 12 month subscription obligation for any cancellation within the 30 day trial period. Simply cancel at PayPal and receive a full refund of the initial monthly subscription payment. While subscribing to OpenRV you are billed according to the "Billing Policies" described below. All refund requests must be in accordance with the terms set forth during the PayPal subscription signup process. In conjunction with this policy, you may cancel a PayPal Subscription Payment at any time, but any refund therein will not be applicable to any remaining portion of your subscription fees, including the 12 month commitment, already in progress as part of your subscription account. All subscription accounts must be paid through PayPal and be secured and enabled through the use of a valid credit card. Therefore if a subscription is canceled, and new PayPal subscription payment must be re-established so that your account does not lapse during the 12 month subscription commitment term. You also agree to provide OpenRV with valid, accurate and up-to-date contact information. Failure to comply may result in the immediate termination of this subscription. You agree to notify OpenRV regarding any billing issues or disputes within 90 days after they have been charged. If any issues or disputes are not brought to OpenRV's attention within this term, you waive your right to dispute them.

Billing Policies

When you purchase a recurring payment RV Park, Campground Owner's, or other Subscription, your credit card will be charged at the time of purchase for your first month of use and then monthly thereafter on the payment date due unless your have agreed to an annual term. In the case of an annual term, your credit card will be charged for the first yearly subscription amount. After your initial payment, your credit card will be automatically charged each month for the use of this application, until you cancel your subscription. If you purchase an annual subscription, your credit card will be charged at the time of purchase for the first years' subscription amount, good for one year. You may receive an email notification 30 days prior to your subscription expiration date that will give you the option to renew the subscription. If no action is taken, your subscription will continue until the actual payment funds have been exhausted in time.

Cancel Information

You may cancel this subscription payment by accessing your Member account at PayPal and following the cancellation instructions. Cancellation of a subscription payment does not relieve the subscriber of his / her obligation to complete the 12 month / 1 year term of any subscription. It is assumed that early cancellation is part of changing charge card accounts through PayPal. In the event you signed up for a minimum commitment period, you will be responsible for all charges for the entire minimum commitment period. This is always 12 months / 1 year for any OpenRV subscription plan.

OpenRV's Right to Terminate or Modify Terms

OpenRV may modify the terms of this subscription, including but not limited to the price, content or nature of the subscription. ResreveRV may notify users when possible, however, many changes in functionality or content will be deemed necessary and may not include subscriber notification due to the complex nature of software source code and software security control. In the event that OpenRV modifies the subscription terms, you may terminate the subscription. OpenRV may terminate this subscription at any time upon notice to you, provided that you will be entitled to receive the subscription for any period for which you have already paid, or a pro-rated refund (to be determined at OpenRV's sole discretion). OpenRV may provide notice by email or by publishing the changes on its Web site. This Agreement will automatically terminate if you fail to comply with any term. No notice shall be required from OpenRV to effect such termination. Upon any termination of this Agreement (whether by you or OpenRV), you shall immediately discontinue use of the subscription product. Your obligation to pay accrued charges and fees shall survive any termination of this Agreement.

Loss, Damage and Confidentiality

You are responsible for maintaining the confidentiality of your password and account information. You are responsible for all activities that occur in your account and you agree to notify OpenRV immediately of any unauthorized account use. OpenRV is in no way responsible for any loss that you may incur as a result of any authorized or unauthorized use of your user account and password, or through the use of the OpenRV web site or any service provided by OpenRV. If you believe there is a security problem please contact OpenRV immediately at the following email address: admin@OpenRV.net. When subscribing to OpenRV, you acknowledge that any loss of data or information, web site content, or any other information related to any interaction or transaction through the use of the OpenRV web site, and any property damage, loss of any kind or any financial loss, or any other damage or loss, is not the responsibility of OpenRV or RV Reservation Services, Inc., an Idaho Corporation.

Email Notification

To communicate critical information related to your subscription, or to notify you of a charge to your account, OpenRV may send you email correspondence. You agree that as a subscriber, OpenRV may send you such email to the address you provide. You will receive this email even if you have opted out of receiving other email from OpenRV. If you do not want to receive this email, you may cancel the subscription at any time as provided in this Agreement. This Agreement is in conjunction with other OpenRV existing policies, located at http://www.OpenRV.net/.

Venue

BY SUBSCRIBING, THE SUBSCRIBER AGREES HENCEFORTH TO JURISDICTION AND VENUE IN THE COMMONWEALTH OF IDAHO FOR ANY CLAIM OR DISPUTE REGARDING THESE TERMS AND CONDITIONS.
